My boyfriends boss came to his house the other day and terminated him. Isnt that against the law? First he wasnt on the clock or anything and now they continue to call him and annoy him even though he no longer is employed with the company. Shoudlnt he have been working? AND …… they never even gave him a warning before the termination……..

thats wrong…. i thiink they should have gave him a fair warning………

There is no law which requires you be fired in the office.

The harrasment is probably illegal, but they can fire you over the phone if they want. At least his boss fired him to his face. Some are cowards & can’t do that.

Generally, they could fire him on the telephone if they wanted. Warnings are not usually required, unless there is an employment contract or a union.

Sounds to me like they thought he was dangerous, so they wanted to fire him immediately and away from the workplace where he could cause trouble.

Don’t know why they are calling him, but if he feels harassed, he should see a lawyer.

was it an on the book job or was he paid under the table?!
If it was under the table the boss can do anything he wants…thats what this sounds like…

They can fire him for any reason they want, as long as it’s not illegally discriminatory…on or off the clock. They can do it in person, by phone, email, pager, text, smoke signal or skywriting.

If he doesn’t work there anymore, however, they shouldn’t be calling him for any reason. He should simply say "don’t call me anymore or I will file a police report for harassment." He should follow through if they ignore him.

A company can fire you anywhere. They can call you on the phone and tell you you are fired. They can take you out to lunch and fire you there. And they also don’t need to give a warning. It’s called "Employment at will", meaning that either side can terminate the employment for any legal reason (they can’t fire you for being a minority or based on your religion or anything like that).

On the other hand, if they are continue to call him and harass him for no reason, he may have a good case for a law suit. If it continues, I would contact a lawyer if I was him.

In most states it is legal to fire someone in any way you want for any reason you want and you don’t have to tell them. If you want more rights for workers, vote democrat.

I think he should have been working, I have never heard of a boss going to the house to fire someone. I think the boss has to give him a reason why he was fired and at least 2 weeks notice, unless he was on a 3 month probation. It sounds like you might have a wrongful dismissal claim, contact a lawyer who deals with wrongful dismissal.That dosen’t make sense that his work calls and harrasses him either, if you have enough proof of this you can sue them in Small Claims Court.
