Working at home is not a novelty anymore. Our forefathers (ever wonder why no one says foremothers) did it and now a lot of us do it and get paid ‘well’ for it. While you have the argument that we are now a lot more ‘tethered’ than we were before with the advent of cell phones, GPS, laptops, etc; we also enjoy a lot more freedom and flexibility and choice. Some of those choices involve continuing to work the traditional 9:00 to 5:00 jobs. Others have opened avenues to earn substantial income using just the investment of time, a little capital (less than $1,000) and a computer connected to the internet. Type in the word ‘income from home’ on any search engine and at last count it returned 158,000 results. You could easily whittle down this list to a few hundred good ones and then shortlist it further to a list of 25-50 worth investigating. From there, a little research and testing should help you identify some winners. So what are you waiting for?

if your boss fire you b/c you can not work overtime, can you get unemployment benefit?

If you fail to work overtime, that may or may not be “cause” for not receiving unemployment. You have to appeal to your state.

No, unless you have a signed employment contract. Employment is "at will", which means it is the will of you or your employer for you to work there. They can fire you for any reason other than the protected discriminations - race, religion, gender, familial status, etc.

if it is mandatory overtime and everyone else has to do it then unfortunately no, you can’t sue him and yes, he can fire you for it. It might even jeopardize you from getting unemployment compensation because it can be called insubbordination.

There are several variables to this; depends on the agreement at time of hire and weither or not your state is an ‘at will’ state.
If the issue of overtime has never been addressed, until the last moment, then you may have a case.
If your state is an ‘at will’ state, meaning they can fire you without cause, then you don’t.

Most employment is "at will" — meaning it can be terminated for a good reason, a bad reason, or no reason at all. Unless you had a contract covering such a situation, or you were fired on one of the bases prohibited by the Civil Rights Act (and corresponding state legislation), you don’t have a case..

Awhile ago at an old job I had, we hired a part-time employee who promptly began taking a lot of days off for illness, car trouble, etc. At the end of about 3 months, the boss realized that she had been absent more days than she had been present. She was let go.

She never told anyone anything about a pregnancy (it was always a different excuse — illness, car trouble, etc.) But just before she was fired, all the women in the office (including the boss) realized that we’d been harboring the same suspicion — that she was pregnant. When she did come to work she had low energy, was distracted, and she had what looked to be a belly bump that was starting to emerge the last couple times we saw her.

So my question is, if she had told us that she was pregnant (instead of making up excuses), would it have been legal to fire her? Can you fire someone for missed sick days if they are pregnant?

I ask because at my work we only get 6 sick days a year and it is REALLY important that people show up to work (I’m a teacher). Could they fire me if I have to take more time off? I’m at a private school, so union rules don’t apply — just normal labor laws.

Does anyone have experience with this?
I am particularly worried because you aren’t supposed to tell anyone until after 3 months. So I feel bad about that girl at the office because she was probably only about 3 months pregnant when she was fired so she was technically doing the right thing by not telling us. Should you tell your boss earlier than 3 months if you are having to take a lot of days off because of vomiting, etc?

In my field of work, we are to report that we are pregnant right way, as soon as we get the pregnancy test. I’m an infectious disease/critical care RN and there are many patients that I just cannot take while pregnant because of radioactive medications etc. So that waiting til the 3 months thing doesn’t apply to us.
I would say it would totally depend on how long you had worked there. For this part-time employee, she seemed new and she seemed to have a lot of issues right off the bat, which played a huge role in getting let go. It is not legal to fire someone due to medical problems, but that doesn’t mean employers can’t find other ways to make the employee’s lives miserable. We had a nurse who worked with us for 30 years, and she suffered as stroke and then a heart attack back to back and was out for 6 months. They posted her position and filled it with someone else. They did not fire her, but she was demoted from assistant manager and had to be a floor nurse. And she had worked for this company 30 years.
Best advice I would give is that you go to work and don’t miss any days, even if you don’t feel well. If you have to miss a day because you are really really sick thats one thing, but just know being pregnant you will be tired and you may be nauseated, and you will feel like that whether home or not. Being a teacher is not hard physical labor per say, you don’t have to lift 300lb patients and you get breaks and time for lunch, which we rarely have. I had to quit working this pregnancy entirely since I miscarried last year on the job and I figured its just not safe for me to work with those patients who are so incredibly sick. As long as you are generally a good employee, you should be fine.

Like if you did something seriously wrong (i.e. making a scene in a crowded store and triggering several customer complaints) and she firmly decides to fire you, can begging make her change her mind? My friend did this at Burger King. Yelled at her boss in front of customers and now she is being fired. If she begged her boss to change her mind, would she?

No. Deciding to fire someone who breaches social and business protocol is necessary. If the boss didn’t fire your friend for this totally inappropriate behavior, she would fully open the business up to verbal abuse by all the employees. What is accepted for one becomes accepted behavior for all. More than likely she would lose customers who witnessed these outbursts. No one wants to pay for a good or service and be forced to see or hear what you described. Kudos to the boss for setting boundaries and sticking to them. Firm means firm. Period.

Example: Let’s say you were just walking, a bus hits you, and you die. Your boss visits your funeral, and he says to you that you’re fired from your job. Can your boss fire you cause you just died from a bus accident, yes or no?

I would almost expect my boss to fire me after I get hit by a bus.

Absent a contract or collective bargaining agreement, that can happen in Ohio and 49 other states.

Also, this has nothing to do with right-to-work, which only affects whether or not you’re required to join a union to hold a job.

If you know your boss was going to fire you would you quit before he gets the chance?

What would be your reasoning?

Hi,
I would wonder first of all how you would absolutely "know" beyond all doubt that you were going to be fired. Did you hear the boss say that or is your place of work one of those who has people in it who love to undermine one another and back stab. Some people love to just stir the pot and cause strife and contention.

Then I would also ask if it’s possibly true, is there something you could be doing differently and haven’t or something the boss wants you to do and you don’t know how? Communication that is mature and non-accusatory can help everyone clear the air and learn. Sometimes mis-communications and assumed understanding is just totally not what the person really means.

Getting fired or asked to resign can be emotionally rough but it can also be a learning experience. You have right to ask what you have or have not done correctly and also request a time period to correct the behavior. I would not quit until I was sure of the real facts. You may need to change the department you are working in if it is a personality conflict, but it may be a lack of communication. I would at least wait and see.

And I mean a personal cell phone… prepaid cell phone.
It was one day after I got off work he called and I didn’t answer and the next day he said he could fire me for not answering.
I work at as a cashier at a gas station, get paid hourly.

Can you prove that this is the reason he fired you? Is the phone yours or the companies?

If so then get a hold of the actual company and let them know the reason for being fired. If there is more than one branch of this company request your job back, but to be transferred. They will then speak with this manager, speak with the manager you will be transferred to, and make sure you are treated with respect.

How do I know this?!
This has happened to my daughter and she worked at Krogers grocery.
